The Mineral Resources (Sustainable Development) Act 1990 ('the MRDA') governs the ownership, search and mining or extraction of sandstone, coal and mineral resources in Victoria.
The basis of the Crown's control under the MRDA firstly is the vesting of ownership of all minerals in the Crown, and the prohibition of mining and exploration for minerals without a mining licence and other authorities.
The MRDA provides for a process similar to Environmental Impact Assessment by which the potential impacts of mining activity can be assessed.
Mining and extractive industries in Victoria are the responsibility of the Minister for Energy, Industries and Resources. The legislation is administered by the Department of Primary Industries.
