This case occurred after the Minister put out guidelines that said people with permits to kill flying foxes didn't have to make a EPBC referral if they were shooting no more than 1.5% of a population. The Court looked at whether the Minister was able to give a general exemption from having to assess action under the EPBC Act to State permit holders.
